Tribunal Affirms Uba' s Senatorial Election, Dismisses Ojukwu's Petition

The election of Dr. Andy Uba as Senator representing Anambra South Senatorial District, Anambra state on March 28, 2015 was late night yesterday affirmed by the Justice Nayai Agabana-led National Assembly Election Petition Tribunal sitting in Awka, the state capital.
The three- man panel in a unanimous judgment held that the petition brought by Senator Uba' All Progressives Grand Alliance (APGA) counterpart in the election,former Executive Vice-Chairman, Nigerian Communication Commission ( NCC), Chief Ernest Ndukwe fell like pack of cards, lacked any proof, was in a coma and therefore dismissed it accordingly.
The Justice also held that Nkpdukwe failed to prove allegation of non- qualification of Uba to contest the election stating that contrary to his claim that the PDP candidate did not possess WASC, he, however was duly cleared by the electoral umpire for the election.
Ndukwe had in his petition urged the tribunal to upturn  declaration of Uba by the Independent National Electoral Commission ( INEC) as winner of the election.
Ndukwe in his petition alleged that results of the election was falsified against him and that Uba was not qualified to stand for the election and urged the tribunal to declare him winner of the polls, claiming that he polled a total of 92,002 votes while Uba who ran under the People's .democratic Party ( PDP) platform secured a total of 88, 325votes.
But Uba in his reply urged the tribunal to dismiss the petition as lacking any merit stating that contrary to Ndukwe's claims, he scored a total of 10532 votes as against Ndukwe's 92,738 votes.

Also, the petition by son of late Igbo leader, Chief Chukwuemeka Odumegwu Ojukwu, Emeka who challenged the election of Hon. Chris Emeka Azubogu as winner of .nnewi-North/Nnewi-South/ Ekwusigo federal constituency has lost his petition wherein he wanted the tribunal to declare him winner of the seat.
